Terms and Conditions for Subscription to Algae Biomass Information Video Channel
Welcome to ALGAFLIX CHANNEL, a subscription-based service that provides information about algae biomass. Algaflix provides a personalized subscription service that allows our members to access algae biomass information in video format (“Algaflix content”).
The Algaflix service is provided to you by the European Algae Biomass Association (EABA). These Terms of Use govern your use of our service. As used in these Terms of Use, “Algaflix service”, “our service” or “the service” means the personalized digital content service provided by EABA for discovering and accessing Algaflix content, including all features and functionalities, recommendations and reviews, our websites, and user interfaces, as well as all content and software associated with our service. References to ‘you’ in these Terms of Use indicate the member who created the Algaflix account and whose payment method is charged.
By subscribing to our service, you agree to abide by these Terms and Conditions (“Terms”). Please read them carefully before subscribing. If you do not agree with these Terms, do not use our service.
2. Subscription and Access
2.1. Eligibility: You must be at least 18 years old to subscribe to the Channel.
2.2 Subscription Plans: We may offer several of subscription plans, including subscriptions offered by third parties in conjunction with the provision of their own products and services. Some subscription plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you. You can find specific details regarding your Algaflix subscription by visiting the algaflix.eu website and clicking on the “Account” link available at the top of the pages under your profile name.
2.3 Account Registration: Your Algaflix membership will continue until terminated. To use the Algaflix service you must have Internet access and an Algaflix ready device and provide us with one or more Payment Methods. “Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party.
To access the Channel, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.4 Subscription Fee: The subscription fee is payable in advance and will be charged to your chosen payment method at the time of subscription. Prices are subject to change, but you will be notified in advance of any price changes affecting your subscription. Unless you cancel your membership before your billing date, you authorize us to charge the subscription fee for the next billing cycle to your Payment Method (see “Cancellation” below).
2.5 Promotional Offers: We may from time to time offer special promotional offers, plans, or memberships (“Offers”). Offer eligibility is determined by Algaflix at its sole discretion and we reserve the right to revoke an Offer and put your account on hold in the event that we determine you are not eligible. Already existing accounts or recent Algaflix membership may not be eligible for certain introductory offers. We may use information such as device ID, method of payment or an account email address used with an existing or recent Algaflix membership to determine Offer eligibility. The eligibility requirements and other limitations and conditions will be disclosed when you sign-up for the Offer or in other communications made available to you.
3. Content and Use
3.1 License: Upon subscribing, you are granted a limited, non-exclusive, non-transferable license to access and view the content on the Channel for personal, non-commercial use only.
3.2 Prohibited Uses: You agree not to:
– Share your account credentials with others.
– Copy, distribute, or disclose any part of the content to third parties without our prior written consent.
– Use the content for any commercial purpose or for the benefit of any third party.
– Modify, translate, or create derivative works based on the content.
3.3 Content Availability: We strive to provide a continuous service but do not guarantee that the content will always be available. We reserve the right to modify, suspend, or discontinue any part of the Channel at any time without prior notice.
4. Payment and Cancellation
4.1 Billing Cycle: The subscription fee for the Algaflix service will be charged to your Payment Method on the specific payment date indicated on the “Account” page. The length of your billing cycle will depend on the type of subscription plan that you choose when you signed up for the service. In some cases, your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid subscription began on a day not contained in a given month. Visit the algaflix.eu website and click on the “Billing details” link on the “Account” page to see your next payment date. If you signed up for Algaflix using your account with a third party as a Payment Method, you can find the billing information about your Algaflix subscription by visiting your account with the applicable third party.
4.2 Payment Method: To use the Algaflix service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated with your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee and any applicable taxes. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of Stripe’s privacy policy. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.
4.3 Updating your Payment Methods: You can update your Payment Methods by going to the “Account” page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
4.4 Automatic Renewal: Unless you cancel your subscription, it will automatically renew at the end of each term. The renewal subscription fee will be charged to your payment method at the beginning of the renewal term.
4.5 Cancellation: You can cancel your Algaflix membership at any time, and you will continue to have access to the Algaflix service through the end of your billing period. Payments are non-refundable and we do not provide refunds or credits for any partial membership periods or unused Algaflix content. To cancel, go to the “Account” page and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing period. To see when your account will close, click “Billing details” on the “Account” page. If you signed up for Algaflix using your account with a third party as a Payment Method and wish to cancel your Algaflix membership, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the Algaflix service through that third party.
4.6 Changes to the Price and Subscription Plans: We may change our subscription plans and the price of our service from time to time. We will notify you at least one month before any price changes or changes to your subscription plan will become effective. If you do not wish to accept the price change or change to your subscription plan, you can cancel your membership before the change takes effect.
5. Algaflix Service
5.1. The Algaflix service and any content accessed through the service are for your personal and non-commercial use only and may not be shared with anyone allowed by your subscription plan. During your Algaflix membership, we grant you a limited, non-exclusive, non-transferable right to access the Algaflix service and Algaflix content. Except for the foregoing, no right, title, or interest shall be transferred to you. You agree not to use the service for public performances.
5.2. The Algaflix service, including the content library, is regularly updated and we may give you the opportunity to watch live or special events (including replays of such content) or to enjoy new additional features. Such content and new features may contain commercial breaks and other types of commercial messages. In addition, we continually test various aspects of our service, including our websites, user interfaces and promotional features.
6. Intellectual Property
6.1 Ownership: All content on the Channel, including videos, graphics, logos, and text, is the property of the European Algae Biomass Association (EABA) or its licensors and is protected by intellectual property laws.
6.2 Trademarks: Any trademarks, service marks, and logos used or displayed on the Channel are the property of European Algae Biomass Association (EABA) or their respective owners.
7. Disclaimers and Limitation of Liability
7.1 Disclaimer: The Channel and its content are provided “as is” without warranties of any kind, either express or implied. We do not warrant that the content will be accurate, complete, or error-free.3.5. Changes to the Price and Subscription Plans. We may change our subscription plans and the price of our service from time to time. We will notify you at least one month before any price changes or changes to your subscription plan will become effective. If you do not wish to accept the price change or change to your subscription plan, you can cancel your membership before the change takes effect.
7.2 Limitation of Liability: To the fullest extent permitted by law, European Algae Biomass Association (EABA) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the Channel.
8. Changes to Terms
We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Channel and updating the date at the top of this document. By continuing to access or use the Channel after those changes become effective, you agree to be bound by the revised Terms.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.
